Company may be excluded from the register of SMEs if it does not provide up-to-date data on the average number of employees

The FTS published information on its website (https://rmsp.nalog.ru/qa.html) that before July 1, 2021, companies belonging to SMEs must confirm their status by providing data on the average number of employees for 2020. If this information is not submitted before the set date, then the company will be excluded from the register. In this case, the company has the right to promptly send the necessary information and recover in the register on the 10th day of the month following the month the FTS received the necessary data, since recently the register of SMEs has been updated monthly.

We remind you that in order to obtain the status of an SME and be included in the Unified Register of Small and Medium-Sized Enterprises, a company with foreign capital must meet three criteria enshrined in Federal Law No. 209 and Decree of the Government of the Russian Federation No. 265 dated 04.04.2016, and the authority to confirm such information and their submission to the tax authority is imposed on audit organizations (part 6.2 of article 4.1 of the Federal Law “On the Development of Small and Medium-Sized Enterprises in the Russian Federation”).
