Our team reminds of the increased responsibility for violations of the legislation of the Russian Federation with regard to personal data

11.04.2021
Ms. Olga Grigorieva
General Director

We bring to your attention that article 13.11 of the Administrative Code of the Russian Federation has been amended by the Federal Law No. 19-FZ of February 24, 2021 “On Amendments to the Code of Administrative Offenses of the Russian Federation”, which toughened administrative liability for violation of legislation of the Russian Federation with regard to personal data.

According to these changes, liability no longer provides for the possibility of giving a notice, and the amount of fines for all subjects of an administrative offense has been doubled.

So, for example, for the lack of written consent, the company can be fined up to 150,000 rubles. Also, a strict innovation is the exclusion of notice as a type of administrative punishment from Art. 13.11 of the Administrative Code of the Russian Federation.

Changes to Part 1 of Art. 4.5 of the Administrative Code provide for an increase in the limitation period from 3 months to 1 year for bringing to administrative responsibility for violations of legislation with regard to personal data. The changes took effect on March 27, 2021.
